Terms of Service

These Terms of Service (the "Terms") are an agreement between you and Kobumura LLC, doing business as SnappShot ("we", "us", "our"), governing your access to and use of the SnappShot service, including the SnappShot website, the hosted dashboard application, and any related APIs, content, or tools (collectively, the "Service").

By creating an account, connecting a data source, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you are at least 18 and that you have the legal capacity to enter into this agreement.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. In that case, "you" refers to both you individually and the organization.

To use the Service, you must create an account. You are responsible for:

One person may not maintain more than one free-tier account. We may suspend or terminate accounts we believe violate this rule.

Subject to these Terms and your payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own business purposes or the business purposes of the organization you represent.

We may investigate any suspected violation of these provisions and take any action we deem appropriate, including suspending or terminating the offending account.

5. Third-party services and your data

The Service connects to third-party platforms (such as RevenueCat, Meta Ads, Google Ads, Twilio, Google Analytics, Stripe, OneSignal, your own database, and others; the "Third-Party Services") using credentials you provide or OAuth authorizations you grant. You are responsible for:

You retain ownership of your data. The business metrics we pull from Third-Party Services on your behalf (for example, your revenue numbers, your ad-spend totals) belong to you or to the underlying Third-Party Service, not to us. We process a cached copy of that data to render your dashboards. When you disconnect a source, we purge the cached data for that source. When you delete your account, we purge all cached data associated with your account.

We do not sell your data or the data we pull on your behalf. We do not use it to train machine-learning models for third-party use. We do not share it with other tenants.

6. Fees, billing, and cancellation

The Service is available on free and paid subscription tiers. Current pricing, plan limits, and included features are listed on our pricing page.

If you subscribe to a paid plan:

Refunds. Subscription fees are generally non-refundable. If we materially reduce the functionality of the Service in a way that breaks your usage, contact help@kobumura.com within 30 days of the reduction and we will consider a prorated refund on a case-by-case basis.

Taxes. Unless stated otherwise, fees do not include applicable taxes, which are your responsibility.

7. Intellectual property

The Service, including its software, design, dashboards, analytics methods, documentation, and branding, is the intellectual property of Kobumura LLC and its licensors. Nothing in these Terms transfers ownership of any of that intellectual property to you.

You may use the Service's output (charts, reports, exports generated from your own data) for your own internal business purposes, including sharing with your team, investors, or advisors. You may not resell access to the Service itself or represent the Service's output as having come from a source other than SnappShot.

8. Feedback

If you send us feedback, feature requests, or bug reports, you grant us a royalty-free, perpetual, irrevocable license to use that feedback to improve the Service. You are not obligated to send us feedback, and we are not obligated to act on any feedback you send.

9. Service availability

We work to keep the Service available and functional, but we do not guarantee uninterrupted availability. From time to time, we may:

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICE IS FREE OF MALICIOUS CODE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

The Service presents data pulled from Third-Party Services. We rely on the accuracy of the data those services provide. We are not responsible for errors, gaps, delays, or inaccuracies originating from a Third-Party Service.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL KOBUMURA LLC OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR:

You agree to indemnify and hold harmless Kobumura LLC and its officers, directors, employees, and agents from any claim, liability, damage, or expense (including reasonable attorneys' fees) arising out of:

You can terminate your account at any time from the Delete Account option in your settings. See our Privacy Policy for what happens to your data when you delete.

On termination, your right to access the Service ends. Provisions of these Terms that by their nature should survive termination (for example, ownership, disclaimers, limitation of liability, dispute resolution) will survive.

14. Dispute resolution

Informal resolution first

Before filing a claim against us, you agree to contact us at help@kobumura.com and attempt in good faith to resolve the dispute informally for at least 30 days. We will do the same if we have a claim against you.

Binding arbitration

If informal resolution does not resolve the dispute within 30 days, both parties agree that the dispute will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will take place in Anne Arundel County, Maryland, or another location the parties agree to in writing. The arbitrator's decision will be final and may be entered as a judgment in any court of competent jurisdiction.

Class action waiver

You and we each waive the right to participate in a class, collective, or representative action against the other. Claims must be brought in an individual capacity.

Exceptions

Either party may bring a claim in small-claims court if it qualifies, or seek injunctive relief in a court of competent jurisdiction for misuse of intellectual property or violation of confidentiality.

Governing law

These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law rules. Any claim not subject to arbitration must be brought in the state or federal courts located in Anne Arundel County, Maryland, and you consent to that jurisdiction.

15. Changes to these Terms

We may revise these Terms from time to time. The updated version is indicated by a new Last updated date at the top of this page. If a change is material, we will give you notice — either in-product or via email to the address on file — at least 30 days before the change takes effect.

Your continued use of the Service after the updated Terms take effect constitutes acceptance of the changes. If you do not agree to a material change, your remedy is to stop using the Service and, if you have a paid subscription, cancel it before the change takes effect.
